Short Term Rentals

The ANC resolution, which was approved by the ANC General Membership at its 30 November 2011 meeting, makes a distinction between the Short Term Rental (STR) that is a homestead occupied by the owner (this would include short term rentals of garage apartments, granny flats and half of a duplex and the occasional rental of the owner’s home itself) and the Commercial Short Term Rental (CSTR) which is a residential property used strictly for investment as a Short Term Rental and is not a homestead or occupied by the owner.

The ANC resolution recognizes the CSTR as a commercial use of residentially zoned property and calls for its prohibition in single family zoned properties (SF-1 through SF-6).  The resolution recognizes zoning as a covenant between the City and the single family property owners.  People who purchase homes in residential neighborhoods do not expect commercial enterprises on adjacent single family zoned properties.  The ANC calls for transient residential use (STR) of property to be defined as a residential rental of 30 days or less, for a maximum total of 60 days per calendar year. The resolution does not call for the prohibition of the owner occupied homesteaded STR.
